HK PRIVACY STATUTES
Unlike many other jurisdictions around the world, Hong Kong does not have an express provision conferring extra-territorial application of its privacy laws. However, the Personal Data Protection Ordinance (PDPO) does establish an overarching framework for the collection, processing, holding and use of personal information through six data protection principles.
In particular, the PDPO prohibits the disclosure of an individual’s personal data without his or her consent to anyone except those who need it for activities related to the purpose for which it was collected (unless there are certain grounds, such as a legal proceeding). It also prevents the disclosure of an individual’s personal information from being publicly displayed together or made available to any person other than a person who needs it for that same activity.
The PDPO does provide some exemptions for the purposes of safeguarding the security of Hong Kong, defence and international relations, crime prevention or detection, assessment or collection of any tax or duty, lawful news activities, life-threatening emergency situations, due diligence exercises or in connection with legal proceedings. There is also a non-exhaustive list of exceptions that allow the use or disclosure of personal information for marketing purposes, provided that it is done in accordance with the PDPO.
