According to the PDPO, personal data collected by an organisation may only be used for a purpose that is lawful and that has been consented to by the individual. In addition, the personal information collected must be necessary and not excessive in relation to the purpose for which it is to be used. An individual is also entitled to object to the use of their personal data for certain purposes, such as marketing or research.

Generally, a person’s consent can be obtained through an opt-out mechanism on a website or through verbal agreement. However, the consent cannot be implied through inaction or silence. The PDPO also stipulates that the data user is liable for any breach of the provisions of the PDPO committed by its agent or contractor. Moreover, a data user must use contractual or other means to ensure that personal data is protected from unauthorised or accidental access, processing, erasure, loss or use, and is not retained for longer than is required for the purpose for which it is processed. Besides, the data user must notify the Information Office of any breaches of the PDPO involving personal data. The Information Officer will then investigate the matter and take the appropriate action. This is particularly important where the breach has a significant impact on the rights of the individuals whose data is being processed.
